By visiting our website, purchasing from our online store, visiting our physical retail location, or receiving operational communications from us, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
The Digging Pit sells vintage and secondhand clothing. All items are described and photographed to the best of our ability, but vintage garments naturally vary in condition, fit, and finish. Sizing may not align with modern standards — we provide flat measurements where possible, and recommend cross-referencing measurements against your own garments before purchasing. Prices are listed in US dollars and may change without notice.
By placing an order, you confirm that the information you submit is accurate and that you are authorized to use the payment method provided. We reserve the right to cancel any order at our discretion, including but not limited to cases of inventory error, suspected fraud, or pricing errors. If your order is canceled, you will receive a full refund to the original payment method.
Orders are shipped via the carriers listed at checkout. Delivery times are estimates; we are not responsible for delays caused by the carrier, weather, or other factors outside our control. Risk of loss passes to the buyer upon delivery to the carrier.
Because our inventory consists of one-of-one vintage items, all sales are final unless an item is materially misrepresented in the listing. If you believe an item you received does not match its listing, contact us at dig@thediggingpit.com within seven days of delivery and we will work with you on a resolution.
We may send transactional SMS notifications to authorized internal staff (business owners and employees) for operational purposes — including inventory sale notifications, low-stock alerts, and high-priority alerts on rare items. Recipients opt in by adding their phone number to our internal staff alerts list and may opt out at any time by replying STOP to any message or by contacting ownership directly. Message and data rates may apply. We do not enroll customer phone numbers in SMS communications without express, separate consent. All site content — photographs, product descriptions, branding, and written material — is the property of The Digging Pit or its licensors and may not be reproduced, redistributed, or used commercially without written permission.
Our website and services are provided on an "as is" basis. To the maximum extent permitted by applicable law, The Digging Pit disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
To the maximum extent permitted by law, The Digging Pit and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if advised of the possibility of such damages. These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law principles. Any dispute arising from these Terms or our services shall be brought in the state or federal courts located in Denver County, Colorado.
